International Criminal Court (ICC)

The International Criminal Court (ICC) is a permanent international court established to prosecute individuals responsible for the most serious crimes of concern to the international community. Created by the Rome Statute, which entered into force on 1 July 2002, the ICC is headquartered in The Hague, Netherlands. Its mission is to ensure accountability for grave international crimes and to help prevent impunity.

The ICC has jurisdiction over four core international crimes: genocide, crimes against humanity, war crimes, and the crime of aggression. Unlike the International Court of Justice (ICJ), which settles disputes between states, the ICC prosecutes individuals, including political leaders, military commanders, and others who are alleged to be responsible for these crimes.

The Court operates on the principle of complementarity, meaning it acts only when national courts are unwilling or genuinely unable to investigate or prosecute the crimes themselves. Cases may be referred to the ICC by a State Party, the United Nations Security Council, or initiated by the Prosecutor with authorization from the Court’s judges, subject to the requirements of the Rome Statute.

The International Criminal Court consists of independent judges, the Office of the Prosecutor, and the Registry. It aims to conduct fair, impartial, and independent proceedings while respecting the rights of victims, witnesses, and accused persons. The Court also provides opportunities for victims to participate in proceedings and, in certain cases, to receive reparations.
